Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "Customer") and StudyHub SA (Pty) Ltd ("StudyHub SA", "we", "us", "our"), a private company registered in the Republic of South Africa, in respect of your access to and use of the website located at kinjani.my (the "Site") and any digital study material sold on the Site (the "Content").

1. Acceptance of these Terms

By ticking the checkbox at checkout, completing a purchase, or otherwise accessing the Site, you confirm that you are at least 18 years of age, or that you are using the Site under the supervision of a parent or legal guardian, and that you accept and agree to be bound by these Terms and our Privacy Policy, Refund Policy and Delivery Policy.

2. The service we provide

StudyHub SA sells digital study packs aimed at South African Matric (Grade 12) and university students. Each pack may include PDF study notes, past papers, memoranda, worked solutions, video lessons and practice quizzes. Availability and contents of specific packs may change over time; the description shown on the product page at the time of purchase governs your order.

3. Pricing and payment

  • All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
  • Payments are processed by Paystack Payments (Pty) Ltd. We do not see or store your card details.
  • Accepted payment methods include Visa, Mastercard, Verve, Instant EFT, and other methods enabled by Paystack from time to time.
  • Your order is confirmed only once Paystack returns a successful authorisation.

4. Delivery

Delivery is digital and by email, in accordance with our Delivery Policy.

5. Refunds and cancellations

Refunds are handled under our Refund Policy, which forms part of these Terms. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 ("CPA") or the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

6. Licence to use the Content

All Content is and remains the intellectual property of StudyHub SA or its licensors and is protected by South African and international copyright law. On payment we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, view, print for personal use, and study the Content for your own educational purposes only.

You may NOT:

  • resell, sublicense, rent, lend, share or otherwise distribute the Content in any form;
  • upload the Content to file-sharing sites, group chats, Telegram, WhatsApp or Google Drive folders accessible to third parties;
  • use the Content for commercial tutoring, group classes or any revenue-generating activity without our prior written consent;
  • remove copyright notices, watermarks or order references embedded in the Content.

We may permanently revoke access, without refund, if we detect a material breach of this licence, including but not limited to piracy or mass sharing.

7. Prohibited use of the Site

You agree not to:

  • attempt to gain unauthorised access to the Site, admin area, or any customer account;
  • use the Site to transmit malware, spam, or unlawful content;
  • use automated scrapers, bots or crawlers against the Site;
  • submit false, misleading or third-party payment information at checkout.

8. Fair-use and educational disclaimer

The Content is provided to support your studies. Academic outcomes depend on individual effort and factors outside our control; no specific mark or pass rate is guaranteed by the sale of any pack.

9. Availability and changes

We may modify, suspend or discontinue any part of the Site or a study pack at any time. We may update these Terms by posting a revised version on this page. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

10. Chargebacks and fraud

If a chargeback is filed against a legitimate purchase, we reserve the right to revoke digital access, report the incident to Paystack, and pursue recovery under South African law. Where we successfully dispute a chargeback, access is restored at no additional cost.

11. Limitation of liability

To the maximum extent permitted by South African law, and without limiting your rights under the CPA, our aggregate liability arising out of or relating to your use of the Site or any Content is limited to the amount you actually paid to us for the transaction that gave rise to the claim. We are not liable for indirect, incidental, special or consequential loss (including loss of profits, marks, or opportunities).

12. Indemnity

You indemnify us against any loss, claim or damage arising from your breach of these Terms, your misuse of the Content, or your violation of any third-party right.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of South Africa. The parties will first attempt to resolve any dispute informally by contacting support@kinjani.my. If unresolved within 30 days, the dispute may be referred to the appropriate court in South Africa. Nothing in this clause prevents you from approaching the National Consumer Commission or the National Consumer Tribunal under the CPA.
